STATE OF EMERGENCY – COVID 19
ORDER # 16
PHASE ONE OPENING OF RESTAURANTS
Beginning 8:00 a.m. 5/4/2020 until rescinded

 

Pursuant to the authority vested in me as Cocoa Beach City Manager by the City Commission of the City of Cocoa Beach, in accordance with Amendment #1, City of Cocoa Beach, Florida, Declaration of Emergency Proclamation, approved May 19, 2020, I hereby Order that all restaurants within the City of Cocoa Beach are permitted to open in accordance with the State of Florida Executive Order 20-112, and in accordance with the conditions contained hereinafter in this Order.  Restaurants may implement the Phase 1 aspects of opening on May 4, 2020 and the following conditions apply: (Whether to open or not is the decision of the owners).

  • Inside occupancy limited to 25% of the number seats approved by the Fire Marshal.

  • No more than 10 people shall sit at one table.

  • Persons sitting at one table shall be located no closer than 6’ to any persons at another table.

  • No seating is allowed at any bar counter (inside or outside).

  • Additional outdoor seating allowed by this Order is Temporary and may remain until this order is rescinded.

  • Tents or canopies are allowed.  Tents larger than 10’X10’ require a permit and an inspection for installation.  There will be no fees for these permits.

  • Additional outdoor seating shall not be placed on public property unless approved by the City Manager.

  • The additional outdoor seating and associated lighting will not cause damage, hazard, nuisance or other detriment to persons or property.  

  • Additional outdoor seating must accommodate any applicable Americans with Disabilities Act (ADA) standards.  

  • Barriers/cones must be used to direct vehicular traffic within any utilized parking lot area and to provide separation from traffic for the dining patrons.

  • The use of portions of on-site existing parking areas cannot result in the reduction of that parking to less than what is required to operate the restaurant based on the reduced occupancy.

  • Remote parking on adjacent or nearby lots is allowable with the approval of the adjacent/nearby lot owner.

Failure to comply with this Order may result in further restrictions being applied.  Fine for violation (pursuant to Cocoa Beach City Code Section 8.5-6) is set at up to $500.00 per occurrence.
